9G Driving provides professional driving tuition, mock driving tests and practical driving test vehicle hire in Redhill, Reigate, Horley and surrounding areas of Surrey.
These Terms and Conditions ("Terms") set out the basis on which 9G Driving / 9G Solutions UK ("9G Driving", "we", "us" or "our") provides driving tuition and related services to pupils ("you", "your" or "pupil").
By booking a driving lesson, purchasing a lesson package, making a payment, or booking our vehicle for a practical driving test, you agree to these Terms.
These Terms are intended to operate alongside, and do not limit, any rights you have under applicable UK consumer protection law.
9G Driving may provide:
Individual driving lessons
Manual driving lessons
Automatic driving lessons
Intensive driving courses
Refresher driving lessons
Mock driving tests
Practical driving test preparation
Practical driving test vehicle hire
Other driving-related tuition agreed between you and 9G Driving
The exact service, lesson duration and price will be confirmed at the time of booking.
Driving tuition is provided by an appropriately qualified and authorised driving instructor where required by law.
Before receiving driving tuition on public roads, you must have the appropriate legal entitlement to drive the vehicle being used for your lesson.
You must:
Hold a valid provisional or full driving licence appropriate for the vehicle and type of driving involved.
Provide your driving licence for inspection when requested.
Provide a DVLA licence check code where reasonably required for licence verification.
Inform us immediately if your licence is revoked, suspended, restricted or otherwise changes.
Inform us of any penalty points, disqualification or other change that may affect your entitlement to drive.
9G Driving may refuse to provide tuition where we reasonably believe that you do not have the appropriate legal entitlement to drive.
We may verify your driving entitlement through the appropriate DVLA process where necessary.
You must be able to meet the applicable legal eyesight requirement for driving.
You may be asked to read a vehicle registration number plate at the statutory distance as part of your driving training.
If you require glasses or contact lenses to meet the eyesight requirement, you must wear them whenever driving.
If you cannot meet the applicable eyesight requirement, you must not drive the tuition vehicle until the matter has been appropriately addressed.
Your instructor may discontinue a lesson where they reasonably believe that you cannot meet the required eyesight standard.
You are responsible for informing the appropriate authorities where you are legally required to disclose a medical condition, disability, medication or other circumstance affecting your fitness to drive.
You should inform your instructor of any condition, medication, impairment or other circumstance that may materially affect the safe provision of driving tuition.
Where necessary for safety or legal compliance, your instructor may decline to provide a lesson until the matter has been appropriately addressed.
Information concerning health will be handled in accordance with our Privacy Policy and applicable UK data-protection law.
You should seek appropriate medical or DVLA guidance where you are uncertain whether a medical condition or medication affects your fitness to drive.
You must not attend a driving lesson while impaired by:
Alcohol
Illegal drugs
Medication that makes you unfit to drive
Fatigue or another condition that makes driving unsafe
If your instructor reasonably believes that you are not fit to drive safely, the lesson may be stopped or refused.
Where a lesson is stopped because of the pupil's impairment or unsafe condition, the lesson may be charged in accordance with the cancellation provisions of these Terms.
Where appropriate, 9G Driving may refuse future bookings where continuing to provide tuition would create a safety or legal risk.
Pupils must wear clothing and footwear that allows them to operate the vehicle safely.
We recommend suitable flat-soled footwear that provides adequate control of the vehicle pedals.
Your instructor may refuse to allow you to drive if your footwear or clothing creates a genuine safety concern.
Lesson dates, times, duration and pickup/drop-off locations will be agreed between you and 9G Driving.
Our normal service areas include:
Redhill (RH1)
Reigate (RH2)
Horley (RH6)
Salfords
Merstham
Surrounding Surrey areas
We may agree to provide lessons outside these areas depending on availability and any additional travel requirements.
Pickup and drop-off locations should be agreed before the lesson.
If you request a different pickup or drop-off location, we may not be able to accommodate the change if it materially affects the scheduled lesson or other bookings.
You are responsible for arriving at the agreed pickup location at the agreed time.
If you arrive late, the lesson will normally still finish at the originally agreed time so that subsequent appointments can be maintained.
The instructor will normally wait for up to 15 minutes at the agreed pickup location.
If you do not attend and cannot reasonably be contacted during that period, the appointment may be treated as a missed lesson.
Any charge for a missed or late lesson will be applied fairly and in accordance with the cancellation terms below.
We understand that circumstances can change. Pupils should provide as much notice as reasonably possible when cancelling or changing a lesson.
Our standard cancellation policy is:
You may cancel or reschedule without a cancellation charge.
A charge of up to 50% of the lesson price may apply.
A charge of up to 100% of the lesson price may apply.
However, cancellation charges will be applied reasonably and proportionately, taking into account the circumstances of the cancellation and any opportunity we have to reallocate the lesson.
A charge will not be applied where doing so would be inconsistent with your statutory consumer rights.
We may consider waiving or reducing a cancellation charge where there are exceptional circumstances.
Examples may include:
Sudden serious illness
Hospitalisation
Bereavement
Emergency circumstances
Other circumstances that reasonably prevented you from providing the required notice
Evidence may be requested where appropriate.
Any decision to waive or reduce a charge will be made reasonably and on the circumstances of the individual case.
Cancellation or rescheduling requests should be sent directly to:
Phone / WhatsApp: +44 7570 141111
Where possible, cancellation requests should be made during reasonable business hours.
The time at which the cancellation message is received may be used to determine the applicable notice period.
A message sent outside normal hours will generally be treated as received when it is reasonably capable of being reviewed, subject to the circumstances.
We may need to cancel or reschedule a lesson because of:
Instructor illness
Vehicle mechanical failure
Vehicle safety concerns
Severe weather
Road closures
Safety risks
Emergency circumstances
Test-day commitments
Other circumstances outside our reasonable control
Where we cancel a lesson, we will normally offer an alternative date or time.
Where a prepaid lesson cannot reasonably be rescheduled, the relevant amount will be refunded or credited as appropriate.
Nothing in these Terms limits your statutory rights where we fail to provide a service in accordance with applicable consumer law.
The price of each lesson, course or other service will be communicated before or at the time of booking.
Unless otherwise agreed:
Individual lessons should be paid for before or at the beginning of the lesson.
Block-booking packages must normally be paid for before the first lesson.
Payments must be made using an accepted payment method.
Any applicable additional charges will be communicated before they are incurred.
9G Driving reserves the right to update its prices for future bookings.
A price already agreed for a confirmed lesson will not be increased retrospectively.
Where you purchase a prepaid block of lessons, the package will specify:
Number of lesson hours
Price
Applicable discount
Any expiry period
Applicable booking conditions
Unless otherwise stated in writing, prepaid block-booking hours are valid for 6 months from the date of payment.
We recommend that pupils book lessons regularly so that the package can be completed within the applicable period.
If you are unable to use your package because of circumstances outside your reasonable control, please contact us so that we can consider the circumstances.
If you decide to discontinue a prepaid package before all lessons have been used, please contact us.
Where a refund is due, the amount may be calculated by:
Identifying the lessons already provided;
Applying the applicable standard individual lesson price to those lessons where appropriate;
Deducting any amount lawfully due for services already supplied; and
Refunding the remaining balance.
Any administration charge must be reasonable and proportionate to the actual administrative costs incurred and will not be applied where prohibited by applicable consumer law.
We will not use a refund term that unfairly prevents a consumer from exercising a statutory right.
Where a booking is made online, by telephone or otherwise as a distance contract, statutory consumer cancellation rights may apply.
In certain circumstances, consumers have a 14-day cancellation period for services.
However, there are circumstances in which the statutory cancellation period may be affected, including where the consumer has expressly requested that the service begins during the cancellation period.
Where a lesson is due to take place during a statutory cancellation period, we may ask you to expressly request that the service begins before the cancellation period ends.
Where the law requires a proportionate payment for services already supplied following a valid cancellation, we will apply the relevant legal requirements.
Nothing in these Terms is intended to remove or restrict any statutory cancellation rights that apply to you.
Pupils are responsible for booking their own practical driving test unless we have expressly agreed otherwise.
We strongly recommend discussing your intended test date with your instructor before booking.
Your instructor may advise you about:
Your current driving standard
Test readiness
Appropriate test dates
Training requirements
Test-centre considerations
However, the final decision to book a practical test remains with the pupil.
Use of a 9G Driving tuition vehicle for a practical driving test is a separate service from the DVSA test fee.
A test-day vehicle package may include:
Pre-test preparation
Warm-up driving
Use of the tuition vehicle during the practical test
Return journey or other agreed arrangements
The exact duration and price of the test-day package will be confirmed before booking.
Payment for the DVSA practical test itself is separate and is made to the DVSA.
You should confirm the availability of the instructor and vehicle before booking a practical test date where you intend to use our vehicle.
We cannot guarantee that our vehicle or instructor will be available for every test date.
If you book a test date without first confirming vehicle availability, we are not responsible for being unable to provide our vehicle on that date.
Your instructor may reasonably decide that the tuition vehicle should not be used for your practical driving test if, in their professional assessment, you have not reached the standard reasonably required for safe and independent test driving.
Where the instructor decides not to provide the vehicle for the test, we will communicate this as soon as reasonably practicable.
Where possible, sufficient notice will be provided to allow the pupil to consider whether to rearrange the test.
This does not guarantee that the instructor's assessment will be correct or that a test result can be predicted.
The purpose of this provision is to protect the safety of the pupil, instructor, examiner and other road users.
If the DVSA cancels or rearranges a practical driving test, the pupil should follow the current DVSA procedure for rearranging the test and claiming any applicable expenses.
DVSA rules regarding compensation or expenses may change from time to time.
Where a test is cancelled by DVSA, 9G Driving will cooperate reasonably with the pupil regarding any associated lesson or vehicle booking.
However, a DVSA reimbursement or expense claim is subject to the DVSA's own eligibility rules and cannot be guaranteed by 9G Driving.
The DVSA may exclude certain costs from compensation, including some instructor vehicle-hire charges. Pupils should check the current DVSA guidance before making a claim.
Our tuition vehicles are maintained and operated in accordance with applicable legal and safety requirements.
Where applicable, vehicles used for tuition will have appropriate:
Insurance
MOT
Road tax
Safety equipment
Dual controls
Maintenance arrangements
The vehicle supplied may change depending on availability, maintenance requirements or other operational circumstances.
Where a replacement vehicle is necessary, we will make reasonable efforts to provide a suitable alternative.
For cleanliness, safety and the comfort of pupils and instructors:
Smoking is not permitted inside a 9G Driving vehicle.
Vaping or use of e-cigarettes is not permitted inside a 9G Driving vehicle.
Food and drinks may be restricted where they create a safety, cleanliness or vehicle-maintenance concern.
These are conditions of using our vehicle and do not represent a statement that every such activity is prohibited by UK law in every circumstance.
Our vehicles may use forward-facing or other vehicle cameras for purposes such as:
Road safety
Insurance
Incident investigation
Vehicle security
Training review
Protection of pupils and instructors
Where personal information is recorded, it will be handled in accordance with our Privacy Policy and applicable data-protection legislation.
Recordings will not be retained indefinitely and will be deleted or overwritten in accordance with our applicable retention practices unless they are required for an incident, legal claim, insurance matter or other legitimate purpose.
Pupils must not use a handheld mobile phone or other prohibited handheld device while driving.
Where a mobile phone is required for navigation or another legitimate training purpose, the instructor will determine how it may safely and lawfully be used.
The instructor may stop the lesson if a pupil uses a device in a way that creates a safety or legal risk.
The person driving the vehicle is responsible for complying with applicable road traffic law.
Where a pupil is driving, the pupil may be personally responsible for offences committed through their driving, subject to the specific circumstances and applicable law.
This may include matters such as:
Speeding
Red-light offences
Bus-lane restrictions
Parking restrictions
Other road traffic offences
Nothing in these Terms is intended to determine legal liability in circumstances where the law places responsibility elsewhere.
Pupils must take reasonable care of the tuition vehicle.
If damage occurs, the circumstances will be investigated.
A pupil will not automatically be responsible for every item of damage simply because the damage occurred during a lesson.
Where we believe damage has resulted from the pupil's negligent, reckless or intentional conduct, we may seek reasonable recovery of the loss where legally permitted.
Any claim will take into account the circumstances and applicable consumer law.
Pupils are expected to behave respectfully towards instructors and other road users.
We do not tolerate:
Threatening behaviour
Violence
Abusive behaviour
Harassment
Discriminatory behaviour
Sexual harassment
Intimidation
Deliberate damage to property
Where serious misconduct creates a safety concern, the instructor may terminate the lesson immediately.
Any decision regarding payment or future bookings will be handled reasonably and in accordance with these Terms and applicable law.
9G Driving expects instructors to provide tuition professionally and with reasonable care and skill.
Pupils should expect:
Lessons of the agreed duration
Professional instruction
Appropriate communication
Appropriate safety standards
Accurate lesson records
Information about driving progress
Clear information about prices and cancellation arrangements
If you believe that these standards have not been met, you may raise a complaint using the procedure below.
Your instructor will provide guidance about your driving progress and areas requiring further training.
No instructor can guarantee:
That you will pass a driving test
The number of lessons you will require
A particular test result
A particular test date
That a particular driving fault will not occur during a test
Driving ability develops differently between individuals, and test readiness will depend on your actual driving performance.

Breach of statutory rights that cannot lawfully be excluded
Any other liability that cannot legally be excluded or restricted

Examples may include:
Extreme weather

Serious road closures

Other significant unforeseen events
Where reasonably possible, we will contact affected pupils and arrange an alternative lesson.

Changes to our services
Changes to prices
Changes to operational arrangements
Changes to applicable law
Changes to DVSA requirements
Changes to our business practices
The version applicable to a booking will generally be the version in force when the relevant contract was formed, unless a change is required by law or otherwise agreed.

These Terms are governed by the laws of England and Wales.
Where you are a consumer, nothing in these Terms affects any mandatory rights or protections available to you under applicable consumer law.
The courts of England and Wales will have jurisdiction, subject to any mandatory rights you may have to bring proceedings in another jurisdiction under applicable consumer law.
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remaining provisions will continue to apply.
